They are parenting arrangements made by the Court for a child after a separation, usually when both parents cannot amicably agree on what\u2019s best for their children.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, former partners who agree on the care of their children can make another type of parenting arrangement. This is called a parenting plan. There are a few key differences between a parenting plan and parenting orders, and the most appropriate option for you depends on your unique circumstances.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Generally, parenting plans are less formal and cheaper than parenting orders. However, they cannot be enforced by the law.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let&#8217;s discuss the differences between parenting orders and parenting plans, and the advantages and disadvantages of each. This can help in deciding which is more applicable to your family situation.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a parenting plan?&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These are agreements made between former partners who have amicably agreed about the care of their children. Some features of parenting plans include:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>They are not formally approved by the <a href=\"https:\/\/www.fcfcoa.gov.au\/fl\/children\/agree\" target=\"_blank\" rel=\"noreferrer noopener\">Federal Circuit and Family Court of Australia<\/a> and are therefore not legally binding.&nbsp;<\/li>\n\n\n\n<li>They are written and signed by both parties but do not necessarily adhere to a specific format.&nbsp;<\/li>\n\n\n\n<li>They provide clarity about parents\u2019 responsibilities and obligations to their children after separation or divorce.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Although parenting plans are not legally binding, they can serve as evidence in Court proceedings regarding the parties\u2019 intentions at the time of agreeing to the parenting plan.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are parenting orders?&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Parenting orders are made by the Court about parenting arrangements for a child after a separation, usually when both parents cannot amicably agree on how to care for their children.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parenting orders are made by the Court in the following ways:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Consent orders \u2014 These are agreed upon between former partners before being approved by the Court, upon which they will be treated the same as any other Court order.&nbsp;<\/li>\n\n\n\n<li>Parenting orders \u2014 Former partners who disagree on parenting arrangements for their children may apply to the Court to make parenting orders that are in the best interests of their children.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Advantages of parenting plans&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Parenting plans are quicker to enter than applying for parenting orders.&nbsp;<\/li>\n\n\n\n<li>It is cheaper to enter a parenting plan.&nbsp;<\/li>\n\n\n\n<li>Since parenting plans are made outside of court, you will most likely not need legal representation.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Disadvantages of parenting plans&nbsp;&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Because parenting plans are not legally binding, they can be unsuitable for parents who do not feel that their former partner will respect the plan.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Advantages of parenting orders&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>They can be legally enforced. Therefore, a party may apply to have the Court enforce the parenting order if the other party has not complied with an order.&nbsp;<\/li>\n\n\n\n<li>Parenting orders do not require consent.
